Prospective buyers are specifically referred to:
1. the existence of the following outstanding and unresolved disputes in relation to this property:
1.1. A dispute with the owners of Khera Niwas (also known as Woodbridge), St. Johns Road, Hazlemere, High Wycombe, HP15 7QR (“Woodbridge”). The owners of Woodbridge claim that they own part of this this property. The part that they claim to own is referred to as the “Disputed Land” in the legal pack. They also claim that the seller is obliged to pay them for the costs they incurred in installing a new boundary fence in 2020. Further details of this claim are also included in the legal pack.
1.2. A dispute with the owners of Kingswood, St Johns Road, Hazlemere, High Wycombe, HP15 7QR (“Kingswood”). The owners of Kingswood claim that the seller is obliged to replace the boundary fence on the western boundary of this property at the seller’s own cost.
2. the positive covenant referred to in Clause 3 and Paragraph 1 of Part IV of the Schedule of the conveyance dated 31 May 1985. A copy of this conveyance is contained within the legal pack. The previous owner gave this covenant requiring her to maintain in good and substantial repair and condition the fences on the west, north and east sides of this property.
This property is being sold subject to the above unresolved disputes and covenant.
